Parimi në Islam është që burri të martohet me një grua dhe të formojnë së bashku një familje me dashuri e harmoni. Por Islami e ka lejuar poligaminë (që një burrë të ketë në të njëjtën kohë disa gra), njëlloj siç kanë vepruar edhe ligjet e mëparshme hyjnore, për hir të disa urtësive dhe interesave në dobi të individit dhe të shoqërisë. Megjithatë, Islami nuk e ka lënë këtë çështje pa rregulla dhe kushte, për të parandaluar padrejtësitë që mund t’i bëhen gruas dhe për të ruajtur të drejtat e saj. Ndër këto kritere përmendim:: 

  1. Drejtësia

Gratë duhen trajtuar në mënyrë të barabartë nga aspekti material, si për shembull në shpenzimet, në radhën e të fjeturit etj. Kush nuk mund të bëjë drejtësi në këtë drejtim, e ka të ndaluar poligaminë, mbështetur në thënien e Allahut të Lartësuar: “Nëse frikësoheni se nuk do të jeni të drejtë ndaj të gjithave njësoj, atëherë mjaftohuni me një grua.” (En-Nisa: 3).
Padrejtësia midis grave është një nga gjynahet më të shëmtuara, siç ka thënë Profeti (Paqja qoftë mbi të!): “Kush ka dy bashkëshorte dhe anon nga njëra prej tyre [e favorizon atë
në kurriz të tjetrës me veprimet e tij], do të vijë në Ditën e Ringjalljes i përkulur mënjanë [ringjallet gjysmë i paralizuar].” (Ebu Daudi 2133).
Ndërsa barazia në dashurinë që ndodhet në zemër, nuk është e detyrueshme sepse është e pamundur për t’u arritur. Ky është edhe qëllimi i thënies së Allahut të Lartësuar: “Ju nuk
do të mund të bëni drejtësi midis grave, edhe sikur të përpiqeni.” (En-Nisa: 129).

  1. Kapaciteti për të shpenzuar për bashkëshortet

Burri duhet të ketë mundësinë financiare për t’i përballuar shpenzimet e të gjitha grave të tij, sepse kjo është e domosdoshme për lejimin e martesës së parë, kështu që për martesën e dytë është edhe më e domosdoshme.

  1. Numri i bashkëshorteve të mos jetë më shumë se 4 (katër)

Ky është kufiri maksimal i poligamisë në Islam, siç ka thënë i Lartësuari: “Atëherë martohuni me ato gra që ju pëlqejnë: me dy, me tri apo me katër; e, nëse frikësoheni se nuk do të jeni të drejtë ndaj të gjithave njësoj, atëherë mjaftohuni me një grua.” (En-Nisa: 3). Kush e pranon Islamin, ndërkohë që është i martuar me më shumë se 4 gra,duhet të mbajë katër prej tyre dhe t’i ndajë (divorcojë) të tjerat.

  1. Ndalohet të bashkohen nën një kurorë gra të caktuara, për të mos prishur lidhjen e gjakut (afrisë) midis tyre, si më poshtë
  • Ndalohet të bashkohen nën një kurorë dy motra.
  • Ndalohet të bashkohen nën një kurorë një grua me tezen e saj.
  • Ndalohet të bashkohet nën një kurorë një grua me hallën e saj.

Udhëzuesi i thjeshtuari muslimanit
