教法规定穆斯林在临终前对自己的遗产应立遗嘱。先知（愿主福安之）说：“任何 一位穆斯林，若有作遗嘱的财物，他还能安然度过两夜，应当写下遗嘱。”伊本欧麦尔 说：“当我听到先知所说，我没等过夜，就写下了自己的遗嘱。”《布哈里圣训集》第 2738段、《穆斯林圣训集》第1627段。

真主在《古兰经》中规定应先执行遗嘱和清还债务再分遗产“【这种分配】，须在 交付亡人所嘱的遗赠或清偿亡人所欠的债务之后”---（妇女章：11）。

这种遗嘱分为以下情况：

  1. 当然的遗嘱： 如果一位 穆斯林身负债务或经济纠 纷，却没有任何的书面证 据，那他必须写下遗嘱来 确定此事。因为还债是当 然，因此立下此项遗嘱也 为当然。
  2. 嘉仪的遗嘱：即穆斯林愿 意在去世后将自己一部分 财产拿出做慈善，如施舍 给一些贫穷的亲戚等，这 必须符合以下条件：
  • 遗嘱不应给任何一位遗产继承 者，真主已为他们分清了各 自的份额，先知（愿主福安 之）说：“遗嘱不给予继承 者。”---《艾布•达伍德圣训 集》3565段、《铁尔米兹圣训 集》第2120段、《伊本•马哲 圣训集》第2713段。
  • 遗嘱应少于遗产的三分之一， 允许三分之一，但禁止超过三 分之一。一位圣门弟子曾想 拿出三分之一以上的钱财作 为遗嘱，但先知阻止了他，并 说：“就三分之一，三分之一 已经够多了。”---《布哈里 圣训集》第2744段、《穆斯林
    圣训集》第1628段。
  • 立遗嘱之人必须是富人，所留遗产够分配给继承者。如果立遗嘱之人是穷人或继承 者需要此笔遗产，那立下遗嘱为憎恶，因为这样就使继承者陷入困境。圣门弟子萨 尔德本艾比宛嘎斯想确立遗嘱，先知（愿主福安之）对他说：“你让继承者成为富 足者，强于使他们受穷向人乞讨。”---《布哈里圣训集》第2744段、《穆斯林圣 训集》第1628段。

先知说：“最好的施舍是施舍水。”

遗产

如果一个人去世了，他就不在拥有生前的钱财，伊斯兰教为我们制定了遗产的分 配，给予每个人应得的份额，这必须在偿还完亡者债务和执行其遗嘱之后。

《古兰经》和圣训为我们辨明了遗产的分配方法，以便在继承者之间不发生任何的 分歧。真主是最公道的遗产分配者。不允许任何人以该方法不同于当地习惯或人情为 借口而改变或替换。真主在讲述完有关遗产的经文后说：“这些是真主的法度，谁服 从真主和使者，真主将使谁入那下临诸河的乐园，而永居其中。这是伟大的成功。”- --（妇女章：13）

亡者的子女或亲属在其亲人去世后应到学者或教法法官处了解遗产的详细分配方 法，这样就能省下不必要的财产纠纷和矛盾。

遗产无论多寡比破坏兄弟关系和家庭关系更卑贱。
